1. Acceptance of terms

By accessing or using WingDex™ ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, you must not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Description of service

WingDex is a web and iOS birding application for logging observations, organizing outings, importing data, and using AI-assisted bird identification. The Service is provided for personal, non-commercial birding and educational use.

3. Account responsibilities

You are responsible for all activity under your account. Keep your authentication credentials secure and notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt unauthorized access to any part of the Service or other users' data
  • Interfere with or disrupt the Service's integrity or performance
  • Transmit malware, spam, or harmful content
  • Circumvent rate limits, API restrictions, or other technical safeguards
  • Scrape or harvest data through automated means without consent
  • Impersonate any person or entity

5. User content

You retain ownership of data and content you submit to WingDex ("User Content"). By submitting User Content, you grant WingDex a limited, non-exclusive, royalty-free license to use, process, store, and display it solely to operate the Service. Photos processed locally for bird identification are not submitted User Content. This license terminates when you delete your content or account from the live Service, subject to the operational and backup retention described in the Privacy Policy.

6. AI-assisted identification

AI-generated bird identification results are not guaranteed to be accurate and should not be relied upon as the sole basis for species identification, scientific research, or any decision with material consequences.

7. Intellectual property

WingDex™ is a trademark of Guan Lun "John" Lian. The WingDex application, source code, design, and original content (excluding User Content and third-party content) are property of the WingDex project and contributors, licensed under the project's open-source license. Third-party content is subject to its respective licenses.

8. Third-party services

WingDex uses infrastructure, authentication, mapping, contact, content, and data services supplied by third parties, including Cloudflare and Cloudflare Turnstile; Resend; GitHub, Google, and Apple; Google Maps; Apple MapKit and Apple Maps; Wikimedia; eBird/Cornell Lab; Geoapify; OpenStreetMap and Nominatim; BirdLife International; and iNaturalist Open Data. Their content and data remain subject to applicable third-party licenses and terms. When you choose social login, submit the private contact form, or follow a link to a third-party website, you interact with those providers, whose terms and privacy policies apply. External links do not imply endorsement, and WingDex does not control third-party content, availability, security, or privacy practices.

9. Availability

WingDex is provided on a voluntary, best-effort basis. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

10. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, WingDex, its maintainers, contributors, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Service.

12. Indemnification

You agree to indemnify and hold harmless WingDex, its maintainers, and contributors from claims, liabilities, damages, and expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access at any time, with or without cause. Upon termination, your right to use the Service ceases immediately. Sections that by nature should survive (including 5, 10, 11, 12, and 15) will survive.

14. Severability

If any provision is found unenforceable, it will be enforced to the maximum extent permissible, and remaining provisions remain in full effect.

15. Governing law

These Terms shall be governed by applicable law, without regard to conflict-of-law principles. Disputes shall be resolved in a forum of competent jurisdiction.

16. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement regarding use of the Service.
